administering the rights of music creators and right holders across the country.
As a non-profit organization established in 1993 under the Copyright and Neighbouring

Frequently Asked Questions- USERS
Any business or entity that plays music in the course of its operations must pay licence fees. This includes establishments such as pubs, mobile DJs, clubs, restaurants, shopping malls, live music venues, and wedding venues. Broadcasters, such as radio and TV stations, that play music publicly also fall under this category. Essentially, if the music use isn't for personal purposes, a licence is required.
The requirement to obtain a music licence is stipulated in the Copyright Act and is part of Namibian law. If the music you play is not written, created, performed, and recorded by you, it belongs to the Music Creator, and you need a licence to use it.
NASCAM supports Music Creators by licensing their works and collecting licence fees from Music Users. The licence fees vary depending on the nature of the music use. Additionally, NASCAM ensures a thriving music industry that continually produces music, enhancing your business environment.
A Music Usage Licence from NASCAM grants Music Users permission to play music publicly at their business or venue. The collected fees, referred to as "licence fees," are distributed to the music creators as royalty income, rewarding them for their hard work and creativity that enriches your business.
Yes, different types of businesses require specific licences based on how they use music. For example, a radio station will need a different licence than a restaurant that uses background music.
NASCAM has extensive experience in understanding music usage and creating fair and reasonable licences.
By supporting musical artists through licence fees, you help sustain a healthy music industry. This support ensures that the creators of your business's soundtrack are incentivized to keep producing music. Paying your licence fees also sends a positive message to NASCAM music creators, encouraging them to perform at your establishment and support your business. Additionally, NASCAM affiliation enhances your business's credibility and can be a valuable addition to your marketing and online presence
Public Performance Rights refer to the rights of creators to be compensated when their music is played publicly. This includes playing music in places such as restaurants, clubs, pubs, shopping malls, and any venue open to the public.
Mechanical Rights pertain to the rights of creators to be compensated when their music is reproduced, such as on CDs, digital downloads, and streaming platforms. It covers the reproduction of music recordings in various formats.
Broadcasting Rights involve the rights of creators to be compensated when their music is broadcast on radio, television, and other broadcasting platforms. This ensures that creators are rewarded for the public transmission of their works.
NASCAM protects the rights of various music creators, including authors, composers, and publishers of music. By representing these rights holders, NASCAM ensures that they receive fair compensation for the use of their creative works.
The validity of a user license varies based on the specific licensing agreement. Generally, licenses are issued on an annual basis and must be renewed each year. Detailed information about the duration and renewal of licenses can be found in the specific terms of the licensing agreement provided by NASCAM.
Purchasing a Music Usage Licence from NASCAM gives Music Users permission to play music publically at their business or venue.
